Terms and conditions

These terms and conditions set out the terms and conditions between you, the customer, and Boujee Designs Pty Ltd (“us”, “we”), governing the use of our website and our downloadable digital recordings   including the content therein (the “products”). Your use of our websites, and purchases, downloads and use of our products, constitutes your full acceptance of these terms and conditions. If you do not agree with these terms and conditions, you should not use our website or purchase, download or use any of our products.

1.0 License and Use

Your purchase of one of our products constitutes our granting to you of a non-exclusive, non-sub-licensable, non-transferable license to download and access that product for the purpose of your own personal use and reference, and print or convert the product to an image or vector format for your own storage, retention and reference (the “purpose”). You agree that under no circumstances shall you use, or permit to be used, any product other than for the aforesaid purpose. For the avoidance of doubt, you shall not copy, re-sell, sublicense, rent out, share or otherwise distribute any of our products, whether modified or not, to any third party. You agree not to use any of our products in a way which might be detrimental to us or damage our reputation.

2.0 Intellectual Property

The products, whether modified or not, and all intellectual property and copyright contained therein, are and shall at all times remain our sole and exclusive property. You agree that under no circumstances, whether the product has been modified or not, shall you have or attempt to claim ownership of any intellectual property rights or copyright in the product.

2.1 Websites

It is the intellectual property of Boujee Designs Pty Ltd and is non-transferable. Websites are rented and cannot be owned. 

2.2 Domain name

The registered domain name of the customer is the intellectual property of Boujee Designs Pty Ltd for the first 3 months, thereafter upon request only, can the domain name be transferred to the customer’s intended hosting company.

2.3 Themes

Themes are sold separately and can only be used on the Boujee Designs Pty Ltd rented websites. These themes are not transferable to any other website or platform, as it is Boujee Designs Pty Ltd intellectual property.  They are also not transferable for cash, sales, or donations to any other person, users nor companies.

3.0 Costs 

3.1 Card Payments and security

Bank account details submitted as part of credit card payments are encrypted via our payment gateway Payfast.

All Payfast payment services are encrypted via an SSL certificate. To protect you, Payfast is forcing 3D-secure transactions for each transaction, whether by credit card or instant EFT. With 3D-secure, the customer must validate the transaction using the OTP sent by the bank to their cell phone number.

3.2 Current customers

The cost of the website is determined by the price of purchase at the time, and will remain that price for a year. However, due to inflation and business costs, Boujee Designs Pty Ltd maintains the rights to change the cost of the website per month, without any prior notice.

3.3 Modification to services and prices

Prices for our products are subject to change without notice, due to sales, business costs and inflation.

Boujee Designs Pty Ltd reserves the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

3.4 Errors, inaccuracies and omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

3.5 Accuracy of billing and account information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

As part of registering or submitting information to receive Paid Services, you also authorize Wix (either directly or through its affiliates, subsidiaries or other third parties) to request and collect payment  and service fees (or otherwise charge, refund or take any other billing actions) from our payment provider or your designated banking account, and to make any inquiries Wix or its affiliates may consider necessary to validate your designated payment account or financial information, in order to ensure prompt payment, including for the purpose of receiving updated payment details from your payment, credit card or banking account provider (e.g., updated expiry date or card number as may be provided to us by your credit card company).

You must keep a credit card stored with Wix to pay for your Paid Services (“Stored Card”). You will be able to identify your Stored Card by its last four digits as in your Account Settings Page.

3.6 Refunds and Chargebacks

Once a product has been purchased by you, no right of cancellation or refund exists under the Consumer Protection (Distance Selling) Regulations 2000 due to the electronic nature of our products (domain name registration). Any refunds shall be at our sole and absolute discretion. You agree that under no circumstances whatsoever shall you initiate any chargebacks via your payment provider. You agree that any payments made by you for any of our products are final and may not be charged back. We reserve the right to alter any of our prices from time to time.

3.7 Cancelation of services and reactivation

3.7.1 If you would like to cancel your service, it would take up to 30 days and one last payment will be made the following month. Understand that if an account has been inactive for a year, the unique domain name would expire after a year and we cannot guarantee that it would be available, this would mean a new name would have to be registered at R250.

3.7.2 Reactivation would be a once-off cost of R500.

4.0 Warranties and Liability

We make every effort to ensure that our products are accurate, authoritaive and fit for the use of our customers. However, we take no responsibility whatsoever for the suitability of the services and products, and we provide no warranties as to the function or use of the product, whether express, implied or statutory, including without limitation any warranties of merchantability or fitness for particular purpose. You agree to indemnify us against all liabilities, claims, demands, expenses, actions, costs, damages, or loss arising out of your breach of these terms and conditions. Furthermore, we shall not be liable to you or any party for consequential, indirect, special or exemplary damages including but not limited to damages for loss of profits, business or anticipated benefits whether arising under tort, contract, negligence or otherwise whether or not foreseen, reasonably foreseeable or advised of the possibility of such damages.

Our service and product in no way can guarantee the same results, as it is based on individual experience. Our stories are true success stories of indiviuals that have used and applied our services to the best of their abilities, along with consistency. 

We are aiding individuals, to stand a better chance at earning higher incomes or stand a better chance at getting job oppertunities in the way they present themselves and is definitely a step in the right direction.

5.0 Uses of services and products

5.1 Prohibited uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any national and international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

5.1 Login details

Login details is not to be shared or used by anyone other than the person who baught it, as it would be considered a false identity and misuse of service.

5.2 Valid information

By purchasing our services or products you agree that all information is valid and true, if it is not Boujee Designs Pty Ltd has the right to take the website down as false identity and information is prohibited.

5.3 Images used

By purchasing our services or products you agree that only images that you have right of ownership can be used or images that are free for personal and commercial purposes, if this is not the case Boujee Designs Pty Ltd has the right to remove all content and takes no responsibility for incorrect usage or loss of our services or products.

6.0 Personal information

We do not share your personal information with anyone unless instructed to do so by the police or any legal entity with a warrant.  For more detail, please refer to our Privacy Policy.

7.0 Changes to terms of services

You can review the most current version of the Terms of Service at any time at this page.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
